11 of August. The State Duma Committee on transport intends to prepare a bill establishing stiff penalties for road services that create emergency situations on the roads.
First Deputy Chairman of the Committee Mikhail Bryachak said he plans to introduce criminal liability for all officials who are responsible for maintaining a proper view of the roadway. The corresponding bill is developed, it will be submitted this fall.
According to the official statistics of traffic police, for the period from January to July 2015 in Russia was about 97 thousand accidents. However, about 35 thousand of them contributed to the unsatisfactory conditions of the arrangement and maintenance of the road network. Thus in these accidents very often people are dying – almost 4.5 thousand people, with 11.8 per thousand of the victims.
That frequently in an accident do not blame the drivers, and potholes on the roads, and sometimes abandoned road services open manholes in the State Duma thought. Deputies in case of road transport accident fatalities occurred from-for unsatisfactory road condition, to punish the officials responsible for the maintenance of the road, imprisonment. Expected timing of the punishment is 3 to 5 years. If the violation was revealed by the control services, or community activists (before the unfortunate events), officials will face administrative liability to a fine or removal from office.
"Currently, there are many complaints of incomplete or untimely performance of technological processes of road maintenance. This topping, and clearing, and timely elimination of damage to the road surface. All this leads to serious accidents," commented Bryachak.
Not all motorists know that now after the accident can be punished traffic, at least the ruble. Under current law, every driver has the right to obtain compensation for the damage that was caused to the vehicle as a result of a traffic accident if it happened because of organizations that are responsible for the quality and reliability of roads. To seek compensation from road services is possible only in a judicial order. But Russian citizens do not like to run to court. Only about 3% of victims go to court for the recovery of damages from the road.
At the same time, addressing the court for protection, it should be understood that the road service will make every attempt to avoid responsibility. It is therefore necessary to gather as much evidence supporting the fact that the accident occurred through the fault of the road (potholes, open manhole), and not, for example, speeding.
Many people think that to win a case in court of road services is extremely difficult, officials allegedly tied to the judges, etc. However, practitioners have noted that it is not. About 90% of writs to road services (according to statistics) are satisfied. In most cases, citizens who won the case, not resorted to paid lawyers.
It should be noted that all roads must meet state standards. In the currently used the state standard says that the size of the pit road must not exceed 5cm in depth, 15 cm long and 60 cm wide. This state standard was developed as a result of tests that showed that if the hole is larger, the risk of injuries to passenger car high. So if you are in a traffic accident after hitting a pothole, it is likely the hole in the road does not meet the GOST. Verify this by measuring the hole, and go to court.
How to arrange an accident occurred on the fault of road
- Cause at the scene of the traffic police, by calling "112".
