Camera photo and video fixation will be able to deprive the rights
The interior Ministry traffic police have developed and brought for approval to the state Duma amendments to the Code about administrative offences in the field of traffic. The amendments provide for stricter liability for violation of the Rules of the road, which was registered by the cameras photos and video recording, as well as applications installed on mobile phones of citizens.
In the case of the adoption of this bill will abolish fines for gross violations of traffic Rules, leaving a single degree of responsibility in the form of deprivation of a driver's license.
Under the bill, in article 12.9 h 7 "overrun of the established speed of movement" proposes to amend by deleting the liability to a fine in the amount of 5 thousand rubles when you commit offences in auto mode cameras photos and video recording.
That is, the traffic police propose to deprive of the rights of all drivers who exceeded the speed limit more than 60 km/h, even if the offence recorded by the cameras photos and video recording or on your mobile the traffic participants.
Help! Currently, a disqualification for exceeding the maximum permitted speed over 60 km/h recorded by the cameras photos and video recording, provided only for a second violation of this article within 1 year from the date of the first violation of the rules.
Deprivation of rights for driving in the wrong lane
The maximum permitted speed is not the only article in which the interior Ministry decided to make changes. Under the bill, it is proposed to amend part 5 of article 12.15 "Re committing an administrative offense under part 4 (departure on a strip intended for oncoming traffic, or on tram ways of a counter direction)" exceptions to liability in the form of a fine in the amount of 5 thousand rubles (if the offence recorded by the camera photo and video recording).
That is, if the bill is passed, in the case of a departure on an oncoming lane where prohibited traffic rules, committed this violation of the complex photo and video recording (as well as road users on their phones), the driver will face disqualification for a period of 1 year.
Help! Currently, the deprivation of rights provided only for the second violation of this article of the administrative code recorded by the camera photo and video recording.
Deprivation of rights for driving in the counter direction on road with one-way traffic
The interior Ministry also plans to make changes to part 3.1 of article 12.16 "Repeated Commission of the administrative offense, provided part 3 of article 12.16 (movement in the counter direction on road with one-way traffic)".
From this article it is also planned to exclude responsibility in the form of a fine in the amount of 5 thousand rubles in case the violation is recorded by the camera photo and video fixation, leaving only the deprivation of rights.
In other words, if the driver will be re-prosecuted under part 3 of article 12.16 of the administrative code for traffic violations recorded by the cameras photos and video recording, it will in any case deprived of the rights instead of paying the penalty of 5 thousand rubles.
What more tightening provided by the bill
Under the bill, citizens will have the right to use photos and videos taken with the app on the mobile phone, as evidence of a violation of traffic rules by road users. About this feature we wrote in our previous article.
Briefly the essence of the changes is to ensure that citizens have an account on the portal of Public services can complain about the violation of traffic Rules by other members of the movement, attaching as evidence a photo or video taken on a mobile phone through a special application.
Accordingly, in the case of the bill, according to records citizens will be instituted administrative proceedings against the responsible drivers, and they will also be able to prosecute. However, it should be noted that to prosecute citizens for photos and videos taken by citizens can be not in all respects. - Part 1 and 3 of article 12.10 of the administrative code "Violation of traffic rules through the railway road."
- Part 1 and 3 of article 12.12 of the administrative code "Journey on forbidding signal of a traffic light or on prohibiting gesture of the traffic controller".
- Part 2 of article 12.13 of the administrative code "Violation of rules of journey of intersections".
- Part 2 and 3 of article 12.14 of the administrative code "Violation of rules of maneuvering".
- Part 4 and 5 of article 12.15 of the administrative code "Violation of rules of location of the vehicle on a carriageway, counter travel or overtaking".
- Part 2 of article 12.16 of the administrative code "Failure to comply with prescribed traffic signs or road markings".
- Article 12.18 of the administrative code "Failure to provide advantage in movement to pedestrians or other road users".
When will enter into force the amendments toughening punishment for drivers
After approval by the State Duma and the Federation Council and signing by the President of the Russian Federation, the law will come into force after 180 days from the date of its publication on the official website of legal acts of the Russian Federation and Rossiyskaya Gazeta (the official source of legal information).
Thus, if the bill will be considered this fall, and will be approved, the new law will come into force from 1 of July 2017. In the autumn if the bill is passed, the amendments will occur no earlier than 1 of September, 2017.
