In this case, in two ways – quota and outside the quota. Depending on this, the required documents differ.
First of all, you need to understand who can obtain a temporary residence permit outside the quota. To such categories of persons include:
1) born in territory of RSFSR and consisting in the past in citizenship of the USSR or born in territory of the Russian Federation;
2) having at least one disabled parent – the citizen of the Russian Federation;
3) recognized incapable of work and having a capable daughter or son – citizens of the Russian Federation;
4) married to a Russian citizen, with residence in Russia;
5) investing in Russia in the amount established by the RF Government;
6) entered military service for a period of military service;
6.1) with a child – citizen of the Russian Federation;
6.2) is a participant of the State program of resettlement of compatriots;
6.3) having a son or daughter over the age of 18 years, consisting in citizenship of the Russian Federation, recognized incapable or restricted in legal capacity;
6.4) under 18 years of age and recognized as incapable or limited in capacity in accordance with the applicable laws of the foreign state receiving the RWP together with the parent (guardian, adoptive parent, guardian) – a foreign citizen;
6.5) under 18 years of age and recognized as incapable or limited in capacity in accordance with the applicable laws of the foreign state receiving the RWP together with the parent (guardian, adoptive parent, guardian) – the citizen of the Russian Federation;
6.6) under the age of 18 years who receive RWP together with the parent (Trustee, guardian, adoptive parent) – a foreign citizen ;
6.7) under the age of 18 years who receive RWP together with the parent (Trustee, guardian, adoptive parent) is a citizen of the Russian Federation.
7) other cases stipulated by the Federal law.
If a foreign national falls under one of the conditions listed above, then it should submit the following documents.
The documents submitted to the FMS of a foreign citizen arriving in the order not requiring a visa, outside of the quota:
- the application for issuance of TRP – 2 copies;
- photographs 35 x 45 mm – 4 PCs.
- the document proving the identity and citizenship – notarized translation (validity not less than 6 months.);
- copy of the migration card, which is marked on the entry of this foreign citizen in the Russian Federation and a mark of territorial body of the Federal body of Executive power in the sphere of migration on issuance to him of the migration card;
- receipt about payment of state fee (for issuance of a permit for temporary residence will be charged state duty in the amount of 1 000 rubles);
- a copy of the notice on statement on the migratory account.
Within 30 days from the date of filing the application to issue a TRP, a foreign citizen must submit:
- the documents confirming absence of drug addiction diseases, infectious diseases that pose a danger to others, stipulated by the list approved by the Government of the Russian Federation and the certificate of absence of disease caused by human immunodeficiency virus;
- at the discretion of the foreign national shall also be submitted notification of its tax authorities – is to be submitted within 1 year from the date of entry in Russia.
Additionally, to confirm the existence of grounds for granting a TRP out of the quota represented by:
- if the foreign national was born in territory of RSFSR and consisted in the past in citizenship of the USSR or born in territory of the Russian Federation – birth certificate issued by the civil registration body on the territory of the RSFSR;
- if the foreign citizen is recognized as incapable of work and has a competent daughter or son – citizens of the Russian Federation and constantly living in the territory of the Russian Federation – a birth certificate and passport son or daughter, the documents certifying the disability of the applicant;
- if a foreign national has at least one disabled parent – RF citizen and resident in the territory of the Russian Federation – a birth certificate and passport disabled parents, documents certifying the disability of the parent;
- if the foreign citizen is married to a citizen of the Russian Federation, permanently residing on the territory of the Russian Federation – marriage certificate and passport of spouse. If the co-applicant live with children who are foreign citizens, additionally submitted documents proving the relationship, or the fact of being adopted and the fact of living together;
- if a foreign national invests in the Russian Federation – the letter head of the organization that attracts investment, indicating the size of the investment;
- if a foreign national has entered the military service contract on passage of military service;
- other documents stipulated by the Federal law.
